B.C. man remains in custody as psychiatric assessments remain incomplete

A B.C. man charged with masturbating in public, as well as theft, remains in in the province’s Forensic Psychiatric Hospital while court orders for psychiatric assessments remain incomplete.

Dylan Dante Ronald Cappadocia, 36, faces the indecent act charge after an alleged Sept. 17 incident on the 2000-block of Vancouver’s Brunswick Street in the presence of one or more people.

The second charge alleges theft of merchandise in excess of $5,000 from a Vancouver London Drugs.

Cappadocia has been in custody since Dec. 2, court records show.

Overnight psychiatric assessments had been ordered by Vancouver Provincial Court Judge Patrica Stark and Judge Andrea Brownstone in December.

Judge Anna-Maya Brown also ordered an in-custody assessment the same month to determine fitness to stand trial.

Psychiatric assessment orders were extended twice by Judge David St. Pierre.

Defence lawyer Andrew Nelson appeared before Judge Harbans Dhillon on Thursday seeking another extension.

Nelson said the time limit on extension is again running out.

“It’s still not been done,” Nelson said. “We’re still no further ahead. Fitness remains an issue.

The court heard Cappadocia has refused to participate in assessments and has denied he has mental health issues.

Dhillon extended the assessment order. A psychiatrist form the hospital may be ordered to attend court to testify as to Cappadocia’s mental health.

Court records do not indicate that Cappadocia has had a bail hearing.
