Returns to board BC’s Public School Employers’ Association (BCPSEA) is appealing a decision by the BC Labour Relations Board (LRB) rejecting BCPSEA’s request for teachers to pay back 15 per cent of their gross salaries.

BC’s Public School Employers’ Association (BCPSEA) is appealing a decision by the BC Labour Relations Board (LRB) rejecting BCPSEA’s request for teachers to pay back 15 per cent of their gross salaries.

The decision from November 29 rejected BCPSEA’s application based on grounds that no precedent existed for such an action. BCPSEA’s argument had been that as teachers are not performing administrative duties under the BC Teachers’ Federation’s (BCTF) current job action, they should be docked a portion of their pay. BCTF maintains that despite the job action teachers are still performing all of their mandated workload and should be paid in full.

BCPSEA disputes the LRB’s argument that it is not its duty to ensure an equal playing field during labour disputes.

“In BCPSEA’s view the LRB clearly has the jurisdiction—and must exercise it—to take steps to maintain an appropriate bargaining dynamic so that an escalation of the strike is unnecessary to bring a resolution to the dispute,” stated a press release.
